Resumo: A partir da mudança de perspectivas incorporada no texto da Constituição Federal de 1988, o Instituto do Patrimônio Histórico e Artístico Nacional (Iphan), responsável pela proteção e salvaguarda do patrimônio cultural no Brasil, precisou responder às demandas surgidas pelo reconhecimento dos bens referenciais da matriz afrodescendente, dentre os quais aqueles relativos às comunidades quilombolas. Assim, o tombamento e, a partir do ano 2000, o registro, instrumentos da política de patrimônio nacional de uso privativo do Iphan, passaram a ser acionados como formas de reconhecimento, proteção e salvaguarda desses bens. Dentro desse universo, o presente trabalho propõe uma reflexão sobre como o(s) patrimônio(s) cultural(is) quilombola(s) vem sendo tratado(s) nesse campo, buscando identificar os conflitos e as possibilidades existentes no reconhecimento de direitos coletivos dessas comunidades através das políticas patrimoniais. Para tanto, são apresentadas e discutidas as ações do Iphan relacionadas aos quilombos no que diz respeito às duas áreas e instrumentos de acautelamento existentes. Além disso, são apresentadas as perspectivas de alguns quilombolas sobre tal temática, a partir da análise de uma oficina realizada no quilombo Chacrinha dos Pretos (Belo Vale/MG), no âmbito de um projeto de capacitação de lideranças quilombolas, que contou com a participação de representantes de seis comunidades quilombolas de Minas Gerais. Através dessa reflexão, as formas de incorporação do patrimônio “não consagrado” pelo Iphan e a separação do campo do patrimônio cultural em duas áreas distintas – do material e do imaterial – são problematizadas.

“Quilombos” and Cultural Heritage: reflections on rights and practices within the field of heritage

Abstract: From the change of perspective embodied in the Constitution of 1988, the Institute of Historical and Artistic Heritage (Iphan), responsible for protecting and safeguarding cultural heritage in Brazil, had to meet the demands arising from the recognition of the properties of reference array of African descent, among those related to communities quilombolas. Thus, two of the instruments of national heritage policy for private use of Iphan, the “tombamento” and, from 2000 onwards, the ”registro”,  have been triggered as forms of recognition, protection and safeguard of such properties. Within this universe, this study proposes a reflection on how cultural heritage of quilombola communities have been treated in the field, seeking to identify the conflicts and possibilities in the recognition of collective rights of these communities through cultural heritage policies. For such, this dissertation presents and discusses Iphan’s actions related to quilombola communities regarding both areas and existing instruments of protection. Beyond that,it presents prospects of some quilombolas on the theme, from the analysis of a workshop held at the Quilombo Chacrinha dos Pretos (Belo Vale/MG), under a training project with leaders of quilombola communities, which was attended by representatives from six quilombola communities. Through this reflection, it problematizes the forms of equity merger of "unconsecrated" heritage by Iphan and the  separation of the field of cultural heritage into two distinct areas - tangible and intangible heritage.
